The ex-couple took to Instagram last week and said they have made the “difficult decision to divorce” with “a great deal of care and consideration”. According to sources, Witherspoon also officially filed for her divorce from Toth in the Nashville court.
According to the court documents obtained, it was actually Witherspoon’s decision to end her marriage. With divorce now on the table and coming into the picture, the idea of Witherspoon paying alimony to her ex-husband in case of divorce is also a possibility.

The statement said, “It is with a great deal of care and consideration that we have made the difficult decision to divorce.” The couple also revealed their priorities after the divorce in the announced statement. The statement further said, “our biggest priority is our son and our entire family as we navigate through this next chapter.”
According to sources, the American actress’ busy schedule was the reason for the end of their marriage.
In the filed court documents, Witherspoon stated that the parties already entered into a Pre-Martial Agreement. According to RadarOnline, the agreement has enough clauses for “adequate and sufficient provisions for the parties’ assets and debts.”
The Wild actress might even have to pay alimony to Jim Toth in the future
According to sources, if both parties end up getting joint custody of their child, Tennessee, Witherspoon might still have to pay alimony to Jim Toth. Since Reese Witherspoon has a net worth of almost $400 million, she is way richer than Toth. There is a possibility that their Pre-Martial Agreement might resolve the issue with the even distribution of their assets. However, in case it does not, the Legally Blonde actress might have to pay alimony to her ex-husband.

According to People, the American actress is “obviously disappointed and upset” with her divorce. Witherspoon first started dating Jim Toth back in 2010 after she broke up with Jake Gyllenhaal. The couple got married back in March 2011 at her ranch in Ojai, California.
