According to reports, the Justice Department has changed its mind and said that, in light of the former president’s denial of author E. Jean Carroll’s allegations of s*xual assault, it no longer thinks that he should be granted immunity.

The civil lawsuit can now proceed to trial in January thanks to permission from the Justice Department. At the time, Trump allegedly made defamatory remarks about the author and later argued that he should be given immunity because he did so while speaking to the media in his capacity as President of the United States.

Justice Department says Donald Trump was motivated by a ‘personal grievance’

According to reports, the Justice Department on Tuesday said in a court filing that there is no strong evidence that proves that former President Donald Trump was acting in his capacity as the POTUS when he made allegedly defamatory remarks about author E. Jean Carroll.

The decision comes three years after the department under both Republican and Democratic leadership had argued that Trump was acting as the POTUS when he denied the alleged allegations made by the author under the Westfall Act. However, according to a report by The New York Times, the department in its filing said that two things have changed since they first moved to intervene.

First, the DC court had clarified the law around what qualified as public work, second, a jury in New York found out that Trump s**xually abused and defamed the author and he has been accused of defaming her again in response to that verdict.

Principal Deputy Assistant Attorney General Brian M. Boynton wrote in the filing,

“The circumstantial evidence of Mr. Trump’s subjective intent in making the allegedly defamatory statements does not support a determination in this case that he was sufficiently motivated by a desire to serve the United States Government.”

He continued, “The history supports an inference that Mr. Trump was motivated by a ‘personal grievance’ stemming from events that occurred many years before Mr. Trump’s presidency.”

Back in 2019, Carroll had accused Trump of s*xually assaulting her in Manhattan’s Bergdorf Goodman department store’s room, claiming that he had forced himself onto her in the mid-90s. At the time, Donald Trump, who was the President, had accused the author of fabricating the story to sell her books.

Trump denied the allegation, adding that he did not know her and he did not r*pe her as she was not his “type”. After the defamatory remarks were made against the author, he decided to file a lawsuit in federal court against the former president.

After New York changed the statute of limitations for civil sexual abuse suits, she sued in state court as well, where in May she was awarded $5 million in damages. The Justice Department has now decided that Trump is no longer entitled to immunity in the second case over defamation, which will go on trial in January.

Donald Trump is not happy with the reverse course decision

As soon as the Justice Department said that Trump is no longer entitled to the immunity, he took to his social media to express his anger, “The DOJ will not defend me in the E. Jean Carroll civil case, which is all part of the political Witch Hunt, lawyered up by a political operative who I just beat in another case, financed by a big political funder, and “judged” by a Clinton appointee who truly hates “TRUMP”’. 

The former president’s statement continued;

“The statements that I made about Carroll are all true. I didn’t r*pe her (I won that at trial) and other than for this case, I have NO IDEA WHO SHE IS, WHAT SHE LOOKS LIKE, OR ANYTHING ABOUT HER.”

He further added, “The Carroll civil case against me is a Miscarriage of Justice and a total scam. The trial was very unfair, with the other side being able to do and present virtually anything they wanted, and our side being largely and wrongfully shut down by an absolutely hostile, biased, and out of control judge”. 

Trump added that his lawyers, due to their respect for the Office of the President and the incredulity of the case, did not want him to testify, or even be at the trial. Carroll is requesting at least $10 million in compensation for remarks former POTUS made about her while she was in the White House and after the jury awarded her $5 million.
