Actor and musician Jamie Foxx has been accused of sexually assaulting a woman at a New York City rooftop lounge in 2015. The alleged victim filed a lawsuit on Wednesday seeking compensation for the incident that she claims caused emotional distress and physical harm.

According to the lawsuit, Jamie Foxx complimented the woman, identified only as Jane Doe, on her looks during an initial interaction, comparing her to model and his former girlfriend Gabrielle Union. He then allegedly took her by the arm to a more secluded area of the Catch NYC lounge’s rooftop.
As per Variety, in this private corner, the suit claims Foxx groped the woman’s breasts under her top before sticking his hand into her pants. The suit alleges Foxx digitally penetrated the woman vaginally and anally without her consent, leaving her in enough pain to later require medical treatment.
A security guard reportedly witnessed the assault but did not intervene. The woman’s friend eventually found her and Foxx ceased his actions and left, according to the legal filing.
Can the Woman Seek Compensation Under New York’s New Law?
The lawsuit seeks unspecified compensation for the “severe emotional distress, pain and suffering” the woman claims she has endured since the attack. She is suing Foxx, nightclub owner Mark Birnbaum, and Catch NYC under New York’s Adult Survivors Act.
The recently enacted law opened a special one-year window for victims to file sexual assault claims even if they would normally fall outside the statute of limitations. The deadline to file is November 23, 2023 – the same day this suit against Jamie Foxx was lodged.
